Advocacy
Procedural representation
Lawyers represent their clients in proceedings before courts and authorities
.Procedural representation of clients before cantonal and federal civil and criminal courts and before administrative justice authorities is reserved for lawyers registered in the cantonal register of lawyers.
Attorneys who are registered in a cantonal register of attorneys may represent parties in proceedings throughout Switzerland without further authorization.
Advisory activity
In addition to litigation, lawyers advise and represent their clients in all legal matters and draft contracts and other legal documents.
Whenever possible, lawyers look for a way to protect their clients' interests without litigation. They inform them about their rights and the legal means to enforce them. If there is already a conflict with an opposing party, they try to reach an out-of-court settlement through discussions. If this is not or no longer possible, lawyers represent their clients before the courts and authorities.
<Independence, professional secrecy and supervision
Lawyers practise their profession independently, in their own name and on their own responsibility.
Lawyers are bound by professional secrecy for an unlimited period of time and vis-à-vis everyone with regard to everything that has been entrusted to them by their clients as a result of their profession. They shall ensure that their assistants maintain professional secrecy.
In the exercise of their profession, lawyers are subject to supervision by the cantonal supervisory authority for lawyers.Notary's office
Necessity of public notarization
The Swiss Civil Code (CC) provides for public notarization for various legal transactions, for example for property purchase contracts.
With the public deed, a legally relevant fact, a legal transaction or a declaration under procedural law is recorded in a document by the notary in a specific form and in a specific procedure. The notary is obliged to record the will of the parties clearly and unambiguously in the deed, to advise the parties and to explain the consequences of their actions.
